This User Agreement (hereinafter - Agreement) governs the relationship between the owners of the website https://wishti.com (hereinafter — Administration) and users (hereinafter — Users). The website https://wishti.com is not a mass media outlet.
By using the website, you agree to the terms of this agreement.

1. Definitions

  • Administration — Nikita Andreevich Komissarov and Alexey Sergeevich Koshelev, jointly determining this Agreement.
  • User Agreement — the Administration's offer to conclude a contract on the terms set forth in this document.
  • Website — the internet website at: https://wishti.com.
  • User — a visitor to the Website.
  • Wishlist — a personal wish list of the User containing descriptions of goods or services without the owner's personal data.
  • Gift — an item in the Wishlist representing a description of a good or service that can be booked by another user.
  • Booking — a voluntary technical action by a User to reserve a Gift, in which:
    • The donor's name may be provided.
    • The website marks the gift as "booked".
    • No contact details are required.
    • No legal obligations for actual gifting are created.
    • Actual gifting is not guaranteed.
    • Does not exclude the possibility of gifting the same item by other persons.

2. General Provisions

  1. The Website is a completely free non-commercial online service designed for creating wish lists and organizing gifts among friends and family.
    Main features:
    • Creating Wishlists
      • Specifying description, date and theme of the event (birthday, wedding, etc.)
      • Adding desired goods and services (Gifts) with descriptions
      • Ability to choose appearance and main image of the Wishlist
      • Ability to create digital invitations for events
    • Booking gifts and services
      • Users who receive a link to the Wishlist can mark gifts they want to give
      • Users can ask anonymous questions about Gifts and receive answers from the Wishlist Author
      • Booking does not obligate the User to actually give the gift — it's simply a mark of intention
      • The Wishlist Author can see which gifts are booked by Users
  2. The User accepts the terms of this Agreement from the moment the User posts any information on the Website.
  3. The Administration reserves the right to verify content published by the User and remove materials that violate the law or website rules.
  4. The Administration provides the Website "as is", does not guarantee its uninterrupted operation, reserves the right to modify the Website, or terminate its operation at any time, and does not guarantee the preservation and availability of information posted by the User.
  5. The Administration does not guarantee the accuracy, completeness, or usefulness of any content posted on the Website and is not responsible for any damage caused by the use or inability to use the Website.
  6. Gift Booking is not a purchase-sale or gift agreement and does not create legal obligations between Users.
  7. The Website is NOT:
    • A commercial platform:
      • Does not conduct sales or intermediary services
      • Does not support payment transactions
      • Does not guarantee availability/quality of specified goods/services (Gifts)
    • A legal instrument:
      • Is not an intermediary in gift transactions
      • Does not record facts of gift transfers
      • Does not maintain documentary records of transactions
      • Is not responsible for fulfillment or non-fulfillment of gift promises
    • A public resource:
      • Does not index lists in search engines
      • Does not provide wish cataloging
      • Does not support mass mailings
    • Technical infrastructure:
      • Is not a file-sharing service
      • Does not support API for third-party developers

3. Website Usage Rules

  1. Use of the Website is permitted only to persons who have reached the age of digital consent.
  2. The User has limited ability to create Wishlists, determine their content, and distribute links to them.
  3. Wishlists are accessible only via direct links that are automatically generated during their creation. The Administration does not index or publish these links in open sources.
  4. The User is responsible for distributing links to their Wishlist. The Administration recommends not publishing links in publicly accessible sources if confidentiality is required.
  5. The Administration reserves the right to delete a User's Wishlist if it becomes subject to mass access or contains content violating the rules.
  6. The User can independently, at any time, modify or delete their Wishlist (or individual elements) through the Website interface.
  7. The User agrees not to post any personal data on the Website except for names when booking gifts.
  8. The User agrees not to publish photos or other materials through the Website that violate legal norms and morality, particularly those containing violence, full or partial nudity, as well as illegal materials, materials violating others' rights, aggressive, pornographic, or obscene materials.
  9. The User agrees not to slander, insult, threaten, impersonate other individuals or legal entities, not to publish personal or confidential information through the Website, including information about credit cards, personal data, and documents of third parties.
  10. Using the Website for commercial purposes without written permission from the Administration is prohibited, including mass mailings, advertising, and spam.
  11. Using automated requests to the Website API, as well as scripts (bots, crawlers, parsers, scrapers, etc.) designed to collect information on the Website is prohibited.

4. Copyright

  1. The User grants the Administration non-exclusive rights to use the data posted by them for any purposes related to the Website's operation, for the entire period of their placement and worldwide, free of charge.
  2. The User guarantees that they possess all necessary rights to the posted images or has obtained permission from the rights holders.

5. Liability

  1. The User is solely responsible for ensuring that the content they post complies with current legislation, including liability to third parties in cases where the User's posting of particular content or the content itself violates the rights and legitimate interests of third parties, including personal non-property rights of authors, other intellectual rights of third parties, and/or infringes upon their intangible benefits.
  2. In case of violation of clause 5.1 of the Agreement, the User agrees to compensate the Administration's expenses for satisfying third-party claims about copyright infringement by the Administration, including expenses for compensation payments to rights holders and legal expenses.

6. Final Provisions

  1. The Website uses Yandex SmartCaptcha for protection against robots. By using the website, you agree to the processing of your device's technical data by this service.
  2. The Administration has the right to modify the Agreement unilaterally. The new version comes into effect from the moment of publication on the Website.
  3. Continued use of the Website after changes to the Agreement means the User's agreement with the new terms.
  4. Processing of the User's personal data is carried out in accordance with the Privacy Policy.
  5. We respond to general questions within 3 working days by email: hello@wishti.com.
  6. All legal requests and claims are reviewed within 30 working days from receipt by email: legal@wishti.com.
  7. All conflicts are initially resolved through negotiations by email: legal@wishti.com. If agreement is not reached — in court at the Administration's location.
